As Kris predicted yesterday, in a unanimous opinion released this morning, the state Supreme Court has rejected the effort by Futurewise and SEIU to keep Initiative 960 off the November ballot. Here's the conclusion.
Appellants challenge the constitutionality of I-960. Such a challenge is not subject to preelection review. While the disputed sections of the initiative may be subject to constitutional challenge, if passed, the initiative does not exceed the scope of the legislative power. The initiative therefore may be placed on the general election ballot.
That concludes the preelection phase of the legal battle, while begging the question of why the Court heard the appeal in the first place. If I-960 passes, I imagine the opponents will be back in court.
